Standard Terms & Conditions of Carriage

STAR DELIVERY COURIER & CARGO WORLDWIDE SERVICE

By tendering any shipment to Star Delivery Courier & Cargo Worldwide Service ("Star Delivery"), the Shipper/Consignor agrees to these Terms & Conditions.

1. Definitions

  • Star Delivery means Star Delivery Courier & Cargo Worldwide Service, its employees, agents, franchisees, contractors, affiliates, representatives, and authorized service partners.
  • Shipper/Consignor means the sender of the shipment, whether acting personally or on behalf of another person.
  • Consignee means the receiver named on the Air Waybill (AWB).
  • Shipment/Consignment means all documents, parcels, packages or cargo accepted under one Air Waybill.
  • Carrier includes airlines, transport companies, freight forwarders, customs brokers and delivery partners engaged by Star Delivery.

2. Acceptance of Shipment

All shipments are accepted subject to these Terms & Conditions.

Star Delivery reserves the right to reject, suspend, inspect, return or dispose of any shipment which:

  • violates applicable laws;
  • contains prohibited or restricted goods;
  • is improperly packed;
  • may endanger persons, aircraft, vehicles or other shipments;
  • contains inaccurate or misleading declarations.

Acceptance of a shipment does not guarantee that the shipment complies with legal or customs requirements.

3. Air Waybill (AWB)

The Air Waybill is non-negotiable.

The Shipper confirms that all information appearing on the AWB is complete, true and accurate.

The Shipper shall be solely responsible for any incorrect declaration, description, value, HS Code, customs declaration or consignee information.

4. Authority of the Shipper

Where the Shipper is acting on behalf of another person, the Shipper warrants that he/she has full authority to enter into this contract on behalf of the owner of the shipment.

These Terms bind the Shipper, Consignee and owner of the shipment.

5. Packaging

The Shipper is responsible for ensuring that every shipment is properly packed, labelled and suitable for transportation by air, road or sea.

Star Delivery shall not be liable for damage caused by inadequate packaging.

Fragile items travel entirely at the sender's risk unless specially packed and insured.

6. Inspection & Security

Star Delivery may inspect, scan, X-ray or open any shipment without prior notice whenever required by law, customs authorities, aviation security regulations or operational requirements.

7. Prohibited & Restricted Goods

Star Delivery will not accept shipments containing, including but not limited to:

  • Dangerous Goods unless previously approved
  • Explosives, Firearms, Ammunition
  • Currency, Precious metals, Precious stones
  • Illegal narcotics, Counterfeit goods
  • Live animals, Human remains
  • Pornographic material
  • Hazardous chemicals, Flammable liquids, Toxic substances
  • Radioactive materials
  • Items prohibited by IATA, ICAO or applicable law.

The Shipper shall indemnify Star Delivery against all losses arising from undeclared prohibited goods.

8. Customs Clearance

Star Delivery may perform customs clearance on behalf of the Shipper or Consignee.

Customs authorities may inspect shipments at any time.

Star Delivery shall not be liable for delays caused by customs inspections, government agencies, import restrictions, quarantine requirements or missing documentation.

The Shipper shall reimburse Star Delivery for all customs duties, taxes, penalties, storage, inspection charges or governmental fees.

9. Transportation

Star Delivery may transport shipments by any route, aircraft, vehicle or carrier selected at its sole discretion.

Shipments may be consolidated with other cargo.

Star Delivery may subcontract all or part of the transportation without prior notice.

10. Delivery

Delivery is completed when the shipment is delivered to: the consignee; an employee; a family member; a receptionist; a security guard; building management; mailroom personnel; or any person appearing to accept delivery at the delivery address.

Electronic proof of delivery, scanned signature or digital confirmation shall constitute valid evidence of delivery.

11. Undeliverable Shipments

If delivery cannot be completed due to incorrect address, refusal, absence of consignee or customs restrictions, Star Delivery may: return the shipment; store the shipment; abandon the shipment where legally permitted; destroy prohibited goods; or sell the shipment where permitted by law to recover unpaid charges.

Additional charges shall apply.

12. Charges

Unless otherwise agreed in writing, the Shipper remains responsible for: freight charges; fuel surcharge; customs duties; taxes; VAT/GST; storage charges; demurrage; airport handling; inspection fees; return charges; and any other governmental or operational charges.

Freight charges are non-refundable once transportation has commenced.

13. Transit Time

Transit times published by Star Delivery are estimates only. Star Delivery does not guarantee delivery dates or times.

No liability shall arise for delays caused by: weather; customs; airline schedules; flight cancellations; security checks; strikes; war; pandemics; government action; force majeure; or events beyond Star Delivery's reasonable control.

14. Insurance

No shipment is insured unless insurance has been specifically requested in writing and the applicable insurance premium has been paid.

Insurance is subject to the insurer's policy terms, conditions and exclusions.

15. Limitation of Liability

Unless higher liability is required by mandatory law or additional insurance has been purchased, Star Delivery's liability shall be limited to the lesser of:

  • USD 100.00 per shipment; or
  • the actual transportation charges paid; or
  • the applicable liability limits under the Warsaw Convention, Montreal Convention, CMR Convention or applicable law.

Star Delivery shall not be liable for: indirect loss; consequential damages; loss of profit; business interruption; market loss; emotional distress; or loss arising from customs delays or government action.

16. Claims

Visible damage: Within 7 days after delivery.

Loss or non-delivery: Within 30 days from shipment date.

Claims must be submitted in writing together with supporting documents. No claim shall be processed until all freight charges have been paid. Failure to comply with these claim periods shall constitute a waiver of the claim.

17. Lien

Star Delivery shall have a general and particular lien over any shipment for unpaid freight, duties, taxes, storage charges or other monies owed.

Where payment remains outstanding, Star Delivery may retain, sell or dispose of the shipment in accordance with applicable law.

18. Force Majeure

Star Delivery shall not be liable for failure or delay resulting from: natural disasters; floods; earthquakes; epidemics; pandemics; acts of God; terrorism; war; civil unrest; airport closures; governmental action; cyber incidents; or any event beyond its reasonable control.

19. Data Protection

The Shipper authorizes Star Delivery to collect, process, store and share shipment information with customs authorities, airlines, government agencies and service partners where necessary for transportation and legal compliance.

20. Governing Law

These Terms & Conditions shall be governed by the laws of the Islamic Republic of Pakistan.

Any dispute shall be subject to the exclusive jurisdiction of the competent courts of Karachi, Pakistan.

SHIPPER'S DECLARATION

The Shipper certifies that:

  • the information provided is complete and accurate;
  • the shipment is properly packed and labelled;
  • the shipment contains no prohibited or undeclared dangerous goods;
  • the shipment complies with all applicable export, import, customs and aviation regulations; and
  • the Shipper has read, understood and accepted these Standard Terms & Conditions of Carriage.
